Before deciding to purchase any of our products or services, you must first read and understand the following information

Terms of Use

The following information sets forth the terms and conditions which apply to your use of the www.TheTradingCoach.com.au website and all Products & Services offered by The Trading Coach International Pty Ltd, ABN 41 646 113 028. By using this website, or any other websites owned by The Trading Coach and purchasing a Service or Program, you are indicating that you agree to be bound by all of these terms. No refunds are possible after 48 hours from lodging membership and paying funds. See the Refund policy for more information.

We reserve the right, at any time, to change or modify the terms and conditions applicable to this website. Such changes will become effective upon posting a revised Agreement on this website, which you can access at any time using the Terms and Conditions link.

Your continued use of our Service after such a change shall be deemed to constitute acceptance by you of any such changes, modifications, additions or deletions.

You agree to review these terms periodically to be aware of any such revisions.

Limitation of liability

In no event shall The Trading Coach International, its subsidiaries or affiliates, or any of their respective employees, officers, directors, agents or representatives (the foregoing entities, collectively, the “The Trading Coach entities”) be liable for any indirect, incidental, special or consequential damages or for loss of profits or business opportunities arising out of (a) this agreement, (b) the The Trading Coach International websites, (c) your use of or inability to use The Trading Coach International websites, or (d) the acts or omissions of The Trading Coach International independent sales representatives, in each event, even if The Trading Coach or such party has been advised of the possibility of such damages. Applicable law may not allow the limitation or exclusion of liability or of indirect incidental, special or consequential damages or loss of profits or business opportunities, so the foregoing limitation or exclusion may not apply to you. The Trading Coach International is not responsible for any unauthorised access to or alteration of your submissions, transmissions or data or for any material or data sent or received or not sent or received. The Trading Coach International is not responsible or liable for any threatening, defamatory, obscene, offensive or illegal content or conduct of any other party (including without limitation any The Trading Coach independent sales representative), or any infringement by a third party of another’s intellectual property, privacy or other rights. In no event shall The Trading Coach’s total liability to you for all costs, expenses, damages, losses and causes of action (whether in contract, tort, negligence or otherwise) arising from or related to this agreement, the The Trading Coach websites, or your use of or inability to use The Trading Coach International websites exceed the amount paid by you, if any, for using or accessing The Trading Coach International websites.

The Right to Refuse Applications

As part of our application process, our management team discusses prospective LIFT applicants and whether LIFT Investor Trader aligns with the goals of prospective applicants to ensure that LIFT would be suitable for that applicant.

During this process, we consider several factors, including:

The need to follow the LIFT Method without other indicators or strategies,

Following the Demo, Live and Compounding Models may not align with your profit goals and timeframes,

The use of non-automated processes in LIFT Trade Entry and Exit under the LIFT License Agreement,

The recommendation of 30:1 leverage in Trading until the Growth Phases of Step 4,

The use of LIFT Strategies only for Personal Use of the LIFT Investor Trader – we only accept applications for individuals and self-managed superannuation funds.

The Management Team have the irrefutable right to refuse an application for LIFT Investor Trader based upon the above and other factors.

Indemnification

You will indemnify and hold The Trading Coach International entities harmless from and against any and all claims, actions, demands, causes of action and other proceedings arising from or related to any of the following (the “claims”): (a) your use of, inability to use, or activities in connection with The Trading Coach International websites; (b) any violation of this agreement or any other The Trading Coach terms, conditions or policies by you or through any account you may have with any The Trading Coach International website; (c) any transaction; (d) any allegation that any submission or other materials that you make available through the The Trading Coach International websites infringe or otherwise violate the intellectual property, privacy, or other rights of any third party; or (e) your violation of any rights of any The Trading Coach International website visitor, user, or customer, or any other third party; and you agree to reimburse the The Trading Coach International entities on demand for any damages, losses, costs, judgements, fees, fines and other expenses they incur (including legal fees and court costs) as a result of any claim(s).

Use of the Materials and Methods taught in the LIFT Investor Trader Support Program

The Trading Coach International is committed to the financial empowerment of individuals and; as such, allows members to use the methods, strategies, systems and materials of this program ONLY for PERSONAL USE within your contract with The Trading Coach International. The methods taught in this program are not to be used for any other purpose, including, but not limited to, trading for clients, trading for companies, trading for groups or associations, distribution for either commercial or non commercial purposes without the implicit written permission and authorisation by The Trading Coach International.

Breach of this will result in legal action against the individuals, organisations or groups involved.

Handbook Agreement and Security

The methods taught in this program and contained in their handbooks are NOT to be used for any other purpose; including, but not limited to, trading for family members or friends, clients, trading for companies, trading for groups or associations, distribution for either commercial or non-commercial purposes without the implicit written permission and authorisation by The Trading Coach International.

All images, logos and written content in these handbooks and the strategies, structures, systems and materials of The LIFT Investor Trader Program and related programs are the exclusive property of The Trading Coach International and its owners and are subject to copyright laws.

It is expressly forbidden to reproduce any of the content either in whole or in part, either in print or digital or by any other means without the written permission of the owners.

Sharing, distributing and copying in any media is a breach of contract and will result in legal action.

Repurchase of lost, destroyed or stolen handbooks.

The LIFT Investor Trader commits to protect their copies of the Handbooks at all times.

Replacements of handbooks can only be made if the previous handbooks are surrendered to The Trading Coach International.

In the event of the loss, destruction or theft of the handbooks, new handbooks can only be purchased if the LIFT Investor Trader can provide (in case of loss) a signed statutory declaration stating the circumstances in which the handbooks were lost, or (in case of theft or destruction) a copy of the police report lodged confirming that the handbooks were stolen or destroyed.

Under the above conditions, the replacement handbooks are available for purchase for $100AUD.

Termination and enforcement

The Trading Coach International is committed to providing a supportive and nurturing environment for our people – including clients and team members. We will not allow negative influences to disrupt or affect this commitment. We will remove anyone from our active membership should they demonstrate that they are disruptive, aggressive or abusive to either clients or team members. This agreement is effective until terminated by The Trading Coach International. You agree that The Trading Coach International, at its sole discretion, may terminate your access to or use of The Trading Coach websites, at any time and for any reason, including without limitation if The Trading Coach International believes that you have violated or acted inconsistently with the letter or spirit of this agreement (including but not limited to your failure to comply with the rules of conduct set forth in section 5 above). Upon any such termination, your right to use The Trading Coach International websites will immediately cease. You agree that any termination of your access to or use of The Trading Coach International websites may be effected without prior notice and that The Trading Coach International may immediately deactivate or delete any user name and/or password used by or provided to you, and all related information and files associated therewith, and/or bar any further access to such information or files. You agree that The Trading Coach shall not be liable to you or any third party for any termination of your access to The Trading Coach International websites or to any such information or files, and shall not be required to make such information or files available to you after any such termination. Before applying for membership in this program, please carefully evaluate whether this program is right for you. The Trading Coach International reserves the right to takes steps that The Trading Coach International believes are necessary or appropriate to enforce and/or verify compliance with this agreement (including without limitation in connection with any legal process relating to your use of The Trading Coach International websites and/or a third party claim that your use of The Trading Coach International websites is unlawful or violates such third party’s rights).

Authorised Use of Photographs, Video Footage, Digital or Printed Materials, Written Testimonials and/or Audio Recording taken by or Provided to or by The Trading Coach

Within The Trading Coach Events, participants will be asked to sign a Photo / Video Release clause on entry. Those people who have signed authorise The Trading Coach and related entities, its assigns and transferees to copyright, use and publish the same in print and/or electronically.

By providing images, video footage or testimonials to The Trading Coach – whether solicited or unsolicited, the individuals who provide the images authorise The Trading Coach and related entities, its assigns and transferees to copyright, use and publish the same in print and/or electronically.

The parties agree that The Trading Coach and related entities may use such photographs testimonials &/or video footage of them with or without their given name and for any lawful purpose, including for example such purposes as publicity, illustration, advertising, and Web content.

The Trading Coach recommends that consumers make themselves fully aware of the terms and conditions relating to their purchases prior to making any purchase.

Disclaimer

The information contained in this website and in our programs is based upon our own and third party research into these services and products.

We do not guarantee that our programs will be suitable for all customers and suggest that customers seek third party advice, should they wish to do so, prior to purchasing any The Trading Coach International products or services.

No refunds will be given for customers who have changed their mind.

Memberships are only in the name of those people listed on the membership application form and cannot be transferred under any circumstance .

Temporary promotional prices are strictly subject to expiry conditions and can be withdrawn at any time.

Neither The Trading Coach International, nor any of its directors are responsible for services provided individually by any other director or office holder of The Trading Coach International.

The training services do not provide any individual advice and do not involve any recommendations in relation to your personal circumstances or beauty needs.

The information on The Trading Coach International websites is intended to be general in nature and is not personal financial product advice. It does not take into account your objectives, financial situation or needs. International LIFT Investor Traders (outside Australia)

Application into the LIFT Investor Trader Program is the commitment of entering into a business contract which is fulfilled by the provision of the services listed on this website. All sales are final and subject to the laws of Victoria Australia.

LIFT Investor Trader is open to residents of countries other than Australia. It is the onus of the applicant to ensure that the markets and methods taught are allowable in their country of residence. Please check this before applying for LIFT Investor Trader. No refund will be given in the circumstances where the LIFT Investor cannot legally use the methods and structures to trade foreign exchange in their country of residence.

Shipment of Handbook Sets to International Clients

To ensure the safe arrival of the LIFT Investor Trader Handbooks, The Trading Coach International will send handbooks via DHL to International applicants upon receipt of their funds and application.

In addition to the LIFT Investor Trader investment, an additional shipping fee of $250AUD is payable to cover shipping costs of handbooks via DHL to international LIFT Investor Traders.

Refund Policy

Upon receipt of application and funds, applicants have 48 hours to withdraw their membership and receive a refund of payment made, less $500 handling fee.

After this time, no refund will be possible.

Fair Go Policy

The Trading Coach International believes in helping those who help themselves…

In this spirit, coaching opportunities will be provided to those LIFT Traders and LIFT Investor Traders who actively follow the coaching processes of LIFT and participate fully in the support structures.

To qualify to receive on on one coaching via Skype, Zoom, phone or face to face, LIFT Traders MUST lodge their Monthly Trade Checkup Sheets.

The Coach may cancel, with notification, one on one coaching requests where the LIFT Trader has not lodged their Monthly Trade Checkup Sheet for the previous month.

Additional support structures such as special coaching events, advanced analysis tools and extended coaching opportunities are reserved for those LIFT Traders and LIFT Investor Traders who demonstrate that they are serious about their trading and moving forward, as well as supporting other LIFT community members in their journey.

As an example, access to aggregated Trade Summaries will be provided only to those LIFT Traders and LIFT Investor Traders who supply their Monthly Trade Checkup Sheet for analysis and to support coaching.

Workshop and Event Booking, Rescheduling and Venue Relocation

We are committed to accommodating the needs of participants in their choice to attend one of our workshops in a nominated location. To ensure the health safety and integrity of the learning there are several factors that impact our ability to schedule and reschedule participants into later courses and to make the decision to relocate workshops to suitable venues:

The venue size

To allow us to offer our very low promotional course fees, we source venues that meet our budgetary requirements – this often means venues have restrictions on numbers that can comfortably seat participants

The venue environment

To ensure that workshop members are given the best space in which to learn, understand and apply the information in our workshops, we have found that the following factors must be met.

Availability of Suitable Workshop Staff

We are committed to ensuring that your workshop host and training team are qualified and experienced to give you a high level of training at our workshops. Occasionally allocated team members become unavailable. We will make every attempt to engage suitable professionals as replacements to offer each workshop. If this becomes impossible, we may need to reschedule that workshop, to ensure the highest level of training provided by the best training team.

Workshop Numbers

Allowing for maximum participant numbers, once we have met our participant numbers, we must close off that course, unless we have cancellations.

Live or Zoom workshops will only be held where we have a minimum of 12 confirmed attendees at least 14 days prior to the workshop. If registrations do not meet these numbers, the workshop will be cancelled.

Confirmation of Membership and Cancellation of Application

Acceptance of the Application to become a LIFT Investor Trader is only confirmed once the application fee has been paid in full and receipt acknowledged via The Trading Coach International.

Participation in Live Workshops and Coaching Nights

As Workshops and Coaching Nights are Group events, every effort will be made to keep the event on-topic and on-time.

We respectfully request that participants consider other participants in their communication during live events. We encourage participation and asking relevant on-topic questions at relevant points in the workshops.

Tuesday Night Coaching Nights are designed to be interactive, with the opportunity for participants to ask on-topic questions and share their relevant experience during the event.

Workshops are designed to provide ALL Event Attendees with a large volume of critical information, strategies and support. Workshops need to keep and maintain flow to ensure that EVERYONE receives the support they need with an effective use of time (many participants will be in other timezones, late at night or taking time from caring for family members – it’s important to respect their time).

We provide ample time at defined points through the workshop, the end of each topic for answering questions. Participants are requested to keep their questions for this time, not during the presentation of the topic, so as to ensure the flow of the workshop.

Personal questions regarding your specific circumstances are best kept to private emails to ives@thetradingcoach.com.au or to your scheduled coaching calls, so that we can give the time to your needs in the best environment to focus on your development.

Rude or aggressive behaviour by participants will not be tolerated. Participants negatively impacting the experience of other attendees will be removed from events.

Incomplete Application Policy

Application fee must be paid in full within 4 business days of signature on (and receipt of) the LIFT Investor Trader Application form.

The Trading Coach International has full discretion to refuse and cancel any application if funds are not received within the timeframe specified above. In this case, any deposit paid will be forfeited by the applicant.

Governing law

This agreement and our privacy and security statement are governed by and interpreted in accordance with the laws applicable to the state of Victoria, Australia, without regard to its conflicts of laws principles. You agree that any dispute or claim arising out of or relating to this agreement and our privacy and security statement shall be resolved only in the courts of Victoria, Australia and you hereby agree to submit to the exclusive jurisdiction of such courts for the purposes of litigating any such dispute or claim.
