Before deciding to purchase any of our products or services, including the LIFT Flex program, you must read and understand the following information.

Terms of Use

The following terms and conditions apply to your use of the www.thetradingcoach.com.au website and your participation in any of the education-only programs provided by The Trading Coach International Pty Ltd (“we”, “our”, “us”).

By using this website or any of our services—including but not limited to purchasing the LIFT Flex – Education Only Program—you are indicating that you agree to be bound by these terms.

We reserve the right to modify these terms at any time. Changes will become effective upon being posted on our website. Continued use of our website and services after such changes constitutes your acceptance of the updated terms.

We recommend you review this page periodically to stay informed of any updates.

Refund Policy

Due to the nature of the LIFT Flex Program as a digital education product, no refunds will be issued after 48 hours from the time of purchase. For more information, please refer to our full Refund Policy.

Limitation of Liability

In no event shall The Trading Coach International, its subsidiaries, affiliates, directors, employees, agents, or representatives (collectively, “The Trading Coach Entities”) be liable for any indirect, incidental, special, or consequential damages, including but not limited to, loss of profits or business opportunities.

You agree that your use of our website and services is at your own risk. In the event of a dispute or loss, The Trading Coach Entities’ total liability will not exceed the amount you paid for the LIFT Flex Program.

Right to Refuse Applications

The LIFT Flex program is designed to support individual traders seeking education and strategy development. As part of our onboarding process, our management team may assess your application to determine alignment with the program’s purpose.

We reserve the irrefutable right to decline any application for the LIFT Flex Program based on the following criteria:

• A mismatch between the applicant’s goals and the educational scope of LIFT Flex.
• Use of the program for anything other than personal education.
• Attempts to use the educational content to trade for clients, organisations, or in a commercial context.
• Non-compliance with the recommended progression through the LIFT Framework.
• Behaviour or conduct inconsistent with our values.

Our team may decline an application at their sole discretion.

Indemnification

You agree to indemnify and hold harmless The Trading Coach Entities from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) resulting from your:

• Use or misuse of the LIFT Flex Program or our websites
• Breach of these Terms and Conditions
• Infringement of any intellectual property or other rights
• Violation of any applicable laws or third-party rights

Use of Materials and Methods (Education Only Licence)

Participation in the LIFT Flex Program grants you access to our education-only materials for personal use only. This means you may not:

• Use the materials to trade on behalf of others, clients, businesses, or groups
• Share, distribute, sell or duplicate any content
• Repurpose our methods for commercial or public teaching, training, or promotional use

Any breach of this agreement may result in legal action.

Intellectual Property and Handbook Agreement

All written content, videos, handbooks, logos, strategies, and tools associated with the LIFT Flex and other programs offered by The Trading Coach International remain the intellectual property of The Trading Coach International.

You may not copy, share, modify, upload, or reproduce any content—either in part or whole—without written permission. Legal action will be taken in the event of a breach.

Termination and Conduct

The Trading Coach International promotes a safe, respectful, and supportive learning environment.

We reserve the right to immediately remove any participant from the LIFT Flex Program if they display behaviour that is:

• Disruptive
• Abusive or aggressive toward clients, staff, or community members
• In breach of any aspect of this agreement

Termination of access does not entitle the participant to a refund if outside the stated refund window.

Governing laws

This agreement and our privacy and security statement are governed by and interpreted in accordance with the laws applicable to the state of Victoria, Australia, without regard to its conflicts of laws principles. You agree that any dispute or claim arising out of or relating to this agreement and our privacy and security statement shall be resolved only in the courts of Victoria, Australia and you hereby agree to submit to the exclusive jurisdiction of such courts for the purposes of litigating any such dispute or claim.
